Sometimes, but often it is treated as battery or another intentional wrong rather than malpractice. The difference matters because malpractice claims can carry shorter deadlines, expert affidavit requirements and damage caps. Courts in different states draw the line differently. ### Can I sue the hospital or clinic, not just the doctor? Often, yes. Hospitals, medical groups and universities can be liable for negligent credentialing, supervision or retention, especially when they received earlier complaints. Whether an employer is liable for the abuse itself under vicarious liability rules varies by state. ### Should I report to the medical board? You can file a complaint with the state licensing board at any time, and it can lead to investigation, discipline or loss of license. A board complaint does not award money, and board proceedings are separate from a civil lawsuit or a police report. ### What if I did not realize it was abuse until later? That is common, especially when abuse was disguised as a legitimate exam. Many states have discovery rules that start the deadline when a patient knew or reasonably should have known of the wrongdoing. The rules vary, so ask a lawyer licensed in your state promptly. ### Does consent matter if the patient agreed? In many professional settings, the law treats a patient's apparent consent as invalid because of the power imbalance. Some states have statutes that make a psychotherapist liable for sexual contact with a patient regardless of consent.
